robocalls directed to people in baltimore city and prince george's county that suggested martin o'malley had already won and there was no need to vote. >> i am calling to let everyone know that governor o'malley has been successful. our goal has been met. the polls were correct. we are ok. everything is fine. the only thing left is to watch it on tv tonight. >> they felt to identify who the calls came from and provided no return number. the real purpose, gansler believes, was to keep people at home. >> it was to suppress voter turnout. we do not tolerate this type of behavior in maryland. >> is charging 112,000 violations of the act and asking the judge to triple the fine. that adds up to $168 million. but early has not commented on

the calls. gansler said there is no evidence he knew about them. -- bob ehrlich has not commented on the calls. >> those 112,000 violations that the attorney general is charging, one for each of the robocalls that was made. delius hanson -- the state prosecutor has issued subpoenas in the case. jayne miller, wbal-tv 11 news. >> tonight the attorney for the embattled doctor accused of implanting unnecessary stents reacted to the hospitals multimillion-dollar settlement. george lettis is live downtown with details. >> in addition to the reaction from that attorney, we are learning more about who brought on the whole investigation.

>> he had thrown dr. midei under the bust. >> the attorney for dr. midei says the answer to those questions are becoming more clear. now that his former employer, st. joseph medical center, just agreed to pay back the federal government 22 in dollars in medicaid and medicare funds to settle a lawsuit. the lawsuit alleges the hospital gave kickbacks to mid atlantic cardiovascular associates in exchange for referrals of patients who needed lucrative procedures. >> that had absolutely no connection to dr. midei in the performance of stents. >> dr. midei is accused of performing heart surgery's although there are not medically necessary. he is mentioned in the st. joseph suit, but did not have to pay. the settlement is the end of what began as a complaint from three whistleblowing cardiac surgeons who work for a

competitor of midlantic cardiovascular associates. the whistle-blowers will now split $2.7 million from the settlement. >> when referrals are made based on the amount how much money is paid, not on the basis of getting you to the best position, that is wrong. that is what they were concerned with. it is not sour grapes at all. people's lives are at stake here. >> of sediment target st. josephs or fraudulent claims, the settlement still says dr. midei performed unnecessary stent procedures. >> in some cases we have pursue criminal charges when we have -- when we believe we have evidence beyond a reasonable doubt. clain washn mclea

acquitted. we are live in baltimore city. george lettis, wbal-tv 11 news. >> maryland's budget gap is growing wider. state legislators are learning by how much and why. david collins is monitoring developments and joins us live from annapolis. >> experts say the budget hole is getting deeper because of increased spending on mandates and entitlement programs such as medicaid. there is one bright spot, slots revenues. next year they could provide $105 million in relief. perhaps it was a case of stunned silence, but no one even cleared their throat estate analyst reveal how much of a budget shortfall lawmakers face next fiscal year. >> there is going to be a gap on a cash basis in excess of $1.6

billion. >> revenue forecasts are weak because the economic forecast is weak. tax dollars are inching in the right direction, but revenue sources are not keeping pace with expenditures. ongoing requirements mandates and entitlements account for 81% of spending. medicaid expenses are said to be the 800 pound gorilla. last year federal dollars help make ends meet, but those funds are gone. now that legislators have details on how bad things are, they will soon turn their attention on finding sources of revenue. governor o'malley has already said his next budget will not contain a new tax. some believe the next legislative session will see an increase in the alcohol tax. opinion polls indicate broad support for raising it as much as 10 cents. it would generate $240 million. senate leaders have long

advocated an income increase in the increase in gasoline tax. state budget experts say teacher retirement costs are up by $75 million. the governor established a commission looking into ways to cut costs. law made -- lawmakers want to ship expenses to local governments. >> lawmakers are expected to reveal some of their bouncing ideas december 16. david collins, wbal-tv 11 news. >> an investigator says to people have been found dead inside of burned out of a body shop parke. cruz said took about an hour to bring the three alarm blaze under control. the victims have not been identified and the cause of the fire is still under investigation.

>> a 17-year-old was charged with helping shooting of another teenager. sterling matthews is being held in the county detention center. he was arrested for killing another teenager outside a row house. anne arundel county police have released a sketch of a man accused of raping a woman in laurell. the victim said she was attacked after taking out the trash on xenia meadow drive monday night. if you have any information on the crime, you are urged to call anne arundel county police at this number. >> tonight, "travel and leisure" magazine has released its list of america's most and least attractive people. charm city got a very dubious ranking. lowell melser has more.

>> it is hard when your this good-looking. i was saying before, i am offended by this because i am a city resident. i take umbrage with "travel and leisure" magazine. a poll of their readers and ask them to rank 35 cities from around the nation, including baltimore, on topics such as best restaurants, airports, and vacation destinations. it also asked them to write the prettiest and ugliest cities. baltimore unfortunately ranked pretty high. could a city known for its charm and beautiful old buildings really be home to some of the ugliest people in the country? we went straight to the top to find out. mayor stephanie rawlings-blake. >> you are an attractive mayor. this must hurt, doesn't it? november 10. a pretty wide range of possibilities this time of year. downtown baltimore is at 61. the eastern shore counties are checking in with a 50's as well. the patuxent naval air station is down to 48 degrees. make henry at 51, frostburg 51. mild november temperatures out west. along the coast, that of a short storm is trying to bring some cloud cover along the coastal beaches there down toward ocean city and downpours virginia beach. around here it will be basically a clear and cool night. 39-46, with northeast winds at 5 miles an hour. the storm is drifting further offshore over the atlantic. high pressure from eastern canada to north florida dominates the weather seen. veterans day looks beautiful. maybe next week we will get a

chance for rain, but this system is falling apart. it will hold off until monday night or tuesday of next week. other than some scattered, hike, fair weather clouds, look for clear nice and sunny days. 63-68 tomorrow, and the days keep getting shorter. sunsets at 4:55 p.m. tomorrow. the same scenario in the central part of the state around the bay, a brisk north win, but temperatures mild and 66 degrees with sunny skies. baltimore sun john expected across much of the lower eastern shore. -- sunshine expected. you might see a few thin clouds, but otherwise very nice with the temperature around 63 degrees. a big football day tomorrow here in town, and 66.

they do not have to worry about the weather under the dome in atlanta. clear skies tomorrow night, back in the low 40's. mainly sunny skies, a few clouds try to move in on sunday but we finish up the weekend with temperatures well above normal. next week, temperatures going back to where they are supposed to beat and slowly a chance for rain arriving. 20% on monday but it moves up to 5050 -- 50-50 by tuesday. >> le'ron mcclain has been hampered said sunday by the question -- he was exonerated. four tackles and havoc wreaked against the dolphins. the sack of chaz henne was the fifth of the season.
